Mandatory liability insurance for 
health care service provider

From November 1st, 2024, the Health Service Provider Mandatory Liability Insurance Act (TOKV) will enter into force. Based on the law, all healthcare service providers operating in the Republic of Estonia are required to have liability insurance, which covers all healthcare services for which they are licensed.

 

This applies to healthcare companies, from small dental offices to large hospitals.

 

It is a mandatory liability insurance, which means that the patient can contact the insurer through his insurance broker to receive compensation.

What type of insurance is it?

 

The healthcare service provider's liability insurance covers the financial obligations arising from the liability from the mistake and/or error made by the healthcare worker during the provision of the healthcare service, including the error of the equipment used.

 

Healthcare workers for the purposes of this insurance product are doctors, dentists, nurses and midwives, and pharmacists who provide pharmacy services. The purpose of health care service provider liability insurance is to spread the risks associated with the provision of health care services by the insured person.

What is covered by the mandatory liability insurance of the healthcare service provider?

  • The property liabilities associated with unlawful damage caused by a person in connection with the provision of health care services are insured

  • An insured event is the direct property damage caused by an error and/or error made by the insured person in the provision of health care services

 

Compensation includes:

  • Claims arising from property damage, which are related to the provision of healthcare services agreed in the insurance contract

  • Legal assistance costs agreed in advance with the insurer through your insurance broker, which are necessary to prove the insured person's liability and/or lack of fault

  • The upper limit of compensation is the amount agreed in the insurance contract, which is the upper limit of the amount of all insurance benefits paid out on the basis of the insurance contract.
